SUMMARY:2024 USET Tribal Climate Resilience Camp
DESCRIPTION:The USET Office of Environmental Resource Management presents the\n2024 USET Tribal Climate Resilience Camp \n  \n  \nUnited South and Eastern Tribes (USET)\, in partnership with the Southeast Climate Adaptation Science Center (SE CASC)\, will convene a Tribal Climate Resilience Camp this year and will support teams representing USET Member Tribal Nations to attend the camp. Participating teams can be comprised of Tribal Leaders\, climate change coordinators\, planners\, program managers\, and/or community members with a goal to gather information\, build skills\, and develop Tribal policies and plans to address climate change impacts. This year’s participants are encouraged to bring specific climate adaptation objectives and/or projects to focus and work on\, and to make headway on resiliency plans. Such projects may include community outreach plans\, adaptation plans\, vulnerability assessments\, funding strategies\, or other related initiatives.  USET’s Climate Camp staff\, facilitators\, and guest speakers will support participants to further develop specific climate adaptation objectives and/or projects. Accordingly\, interested USET Member Tribal Nations and their teams should apply early to allow USET to prepare and ensure resources and facilitators are available to fit each project. \n  \n\nWhen: June 10-14\, 2023 \n\nJune 10 | 5:00 pm Eastern (Suggested travel day and kick-off dinner)\nJune 11 – 13 | 8:00 am – 5:00 pm Eastern each day\nJune 14 | 8:00 am Eastern (Breakfast and departure)\n\n  \n\nWhere: The Avila Center\, 711 Mason Rd.\, Durham\, NC 27712\nReservations will be made for attendees when they register for the camp. \n  \n\nWho should attend: This year we are encouraging Tribal Nations to bring with them\, to the camp\, specific climate adaptation objectives and/or projects to focus on\, work on\, and make headway on during the week. So\, ideal candidates to comprise a Tribal Nation’s team for this year’s camp would be any individual connected to those objectives or projects. USET’s Climate Camp staff\, facilitators\, and guest speakers will all be on hand to support you\, whether you’re working alone or as a team\, to begin making progress on those specific climate adaptation objectives and/or projects. \nWe recognize that some Tribal Nations may only be able to send one participant to the Camp. These “Teams” of one are still encouraged to register and attend and will be grouped with other individual participants to benefit from peer learning and discussion opportunities. \nProspective attendees are encouraged to view a brief video (below) on the camp held in the traditional homelands of the Wabanaki at the Schoodic Institute. This camp was hosted by the Penobscot Nation. \n \n\nCamp Objectives: \n\nLearn examples of Tribal climate adaptation planning.\nIdentify climate adaptation resources from climate adaptation science centers.\nBuild camaraderie with your Tribal Nation team.\nDiscuss how climate adaptation can align with the values and priorities of your Tribal Nation/community.\nCreate a strategy to engage your Tribal Nation/community in climate adaptation planning.\nBring with you a climate adaptation objective or a climate adaptation/resilience project to focus on\, work on\, and make headway on with a team of dedicated camp facilitators to help and support you all week!\n\n\nAgenda (as of 5/28/24) \nAgenda at-a-glance \n \n  \n\nRegister \nRegistration is open. There is no fee for registration. Space is limited (~30 Tribal participants)\, and limited spots will be appointed on a first come first serve basis. Registration closes on May 10. \n\nTravel Information \nMeals and lodging for Tribal Nation teams at the Avila Retreat Center will be covered by the program. Tribal Nation teams\, however\, are responsible for covering all travel costs getting to and from the event (including but not limited to airfare\, airport parking\, mileage\, per diem\, car rental or other expenses on travel days).  Teams or individuals from federally recognized Tribal Nations may request stipends for travel reimbursement. The Raleigh Durham International Airport is about 24 miles from the Avila Center. Travel options to and from the airport and Avila center could include taxis\, rideshare\, or vehicle rental. If limited by travel funding\, please contact the USET camp coordinators. We will have a limited number of travel stipends on a first come first serve basis. \n\nCOVID Protocols  \nThe USET Tribal Epidemiology Center (USET TEC) is a recognized public health authority supported by the Tribal Nations within the USET region. Throughout the course of the COVID pandemic\, we have relied on their expertise to guide us to ensure for the overall safety\, health\, and wellness for our members\, staff\, and event attendees. As the impacts of COVID have evolved\, we have continued to assess our protocols to ensure that they remain reflective of the current status of the pandemic. \nCurrently (as of 04/17/2023\, subject to change)\, USET is no longer requiring proof of vaccination to attend USET-sponsored meetings. This ECHO merged the previous COVID-19 and Hepatitis C ECHOs and will focus on a different topic every month. For USET Member Tribal Nation participants\, OERM is offering assistance to conduct testing at Tribal schools and child-care facilities. USET will assist with sampling Tribal childcare facilities\, and will collect data such as sampling results and facility location on behalf of participating Member Tribal Nations. DESCRIPTION:Dear Tribal Leader\, \nOn June 13\, 2024\, from 2-5 p.m. ET\, the U.S. Department of Education (ED) will conduct a Tribal Consultation on the implementation of the Build America\, Buy America Act and Tribal data sovereignty. This consultation advances the Department’s commitment to uphold the federal trust responsibility as described in Executive Order 13175 – Consultation and Coordination with Indian Tribal Governments and Executive Order 14112 – Reforming Federal Funding and Support for Tribal Nations to Better Embrace Our Trust Responsibilities and Promote the Next Era of Tribal Self-Determination. \nThe Tribal consultation will be conducted by the Office of Indian Education and facilitated by the White House Initiative on Advancing Educational Equity\, Excellence\, and Economic Opportunity for Native Americans and Strengthening Tribal Colleges and Universities. \nRegister for the Tribal Consultation. \nPlease follow the registration link above to participate in the consultation. This consultation is a closed press event. \nBackground\nBuild America\, Buy America Act (BABAA) \n\nOn November 15\, 2021\, President Biden signed the Infrastructure Investment and Jobs Act P.L. 117-58 (IIJA) into law. A component of the IIJA is the Build America\, Buy America Act (Division G\, Title IX of the IIJA) (BABAA).\nBABAA establishes for all covered Federal agencies (including the U.S. Department of Education (ED))\, the following domestic content procurement preference requirement: “none of the funds made available for a Federal financial assistance program for infrastructure…may be obligated for a project unless all of the iron\, steel\, manufactured products\, and construction materials used in the project are produced in the United States.”\nAt ED\, infrastructure and the corresponding BABAA domestic sourcing requirements are generally limited to construction and broadband infrastructure.\nAfter review and a public comment period\, ED may waive BABAA requirements when (1) applying the preference would be inconsistent with the public interest; (2) types of iron\, steel\, manufactured products\, or construction materials are not produced in the United States in sufficient and reasonably available quantities or of a satisfactory quality; or (3) the inclusion of iron\, steel\, manufactured products\, or construction materials produced in the United States will increase the cost of the overall project by more than 25 percent.\nFor ED\, BABAA requirements went into effect as of October 1\, 2022.\nED consulted with Tribes on August 23\, 2022\, regarding BABAA implementation before that implementation date. ED also heard consultation with Tribal Nations through a September 21\, 2022\, consultation hosted by the White House Council on Native American Affairs and other agencies.\nSince that time\, OMB has established regulations regarding BABAA implementation\, which are available at 2 CFR part 184\, and supporting guidance in M-24-02 – Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure.\n\nED has 4 agency-level waivers currently in effect: \n\nPublic Interest Tribal Consultation Waiver for Financial Assistance Agreements with Tribes: Applicable 2/7/2024 – 2/6/2025. This waiver applies to federally recognized Tribes\, including their governmental arms and instrumentalities\, or Tribal organizations (Federal financial assistance recipients who are Tribally Controlled Colleges and Universities (TCCUs) are included in the scope). The waiver allows the use of non-domestic iron\, steel\, manufactured products\, and construction materials in infrastructure projects and activities. The waiver applies to grants obligated on or after 2/7/2024\, and\, in the case of grants obligated before 2/7/2024\, but after 10/01/2022\, the waiver applies to all expenditures for non-domestic iron\, steel\, manufactured products\, and construction materials incurred after 2/7/2024.\nDe Minimis\, Small Grants\, and Minor Components Waiver: Applicable 7/31/2023 – 7/30/2028. The De Minimis element sets a De Minimis infrastructure project purchases threshold of 5% of total applicable project costs. Applicable project costs are defined as material costs subject to the Buy America domestic content procurement preference up to a maximum of $1\,000\,000. The Small Grants element applies to awards with total federal funding at or below the Simplified Acquisition Threshold\, which is currently set at $250\,000. The Minor Components element allows infrastructure grantees to use non-domestically produced miscellaneous minor iron and steel components comprising no more than 5% of the total material cost of an otherwise domestically produced iron and steel product. This waiver applies to infrastructure grants obligated on or after 7/31/2023\, and\, in the case of grants obligated before 7/31/2023\, but after 10/01/2022; the waiver will apply to all expenditures for non-domestic iron\, steel\, manufactured products\, and construction materials incurred after 7/31/2023.\nPublic Interest Waiver for the Pacific Island Territories of the Commonwealth of the Northern Mariana Islands\, Guam\, and American Samoa: Applicable 1/2/2024 – 1/1/2025. This waiver permits the use of non-domestic iron\, steel\, manufactured products\, and construction materials in infrastructure projects located within the Pacific Island Territories (PITs) when the total Federal award exceeds the Simplified Acquisition Threshold\, currently set at $250\,000. The waiver applies to PIT infrastructure grants obligated on or after 1/2/2024\, and\, in the case of grants obligated before 1/2/2024\, but after on or after 10/01/2022\, the waiver applies to all expenditures for non-domestic iron\, steel\, manufactured products\, and construction materials incurred after 1/2/2024.\nPublic Interest Waiver for Certain Previously Planned Infrastructure Projects: Applicable from 11/3/2023 – 11/2/2025. Waives BABAA requirements for ED awards obligated on or after 11/3/2023 that support (i) contracts that ED grantees entered into prior to 10/1/2022 and/or (ii) contracts entered into before 3/1/2023 resulting from solicitations published before 5/14/2022. For awards and amendments that otherwise meet these criteria but which were obligated before 11/3/2023\, the waiver applies to eligible expenditures on or after 11/3/2023.\n\nListed below are the Department-administered grant programs subject to the BABAA requirements that are more likely to award grants to Tribes or Tribal organizations: \n\nAlaska Native Education (Assistance Listing Number 84.356A)\nAmerican Indian Tribally Controlled Colleges and Universities (Part F) (ALN 84.031D)\nAmerican Indian Tribally Controlled Colleges and Universities (ALN 84.031T)\nIndividuals with Disabilities Education Act Part B\nIndividuals with Disabilities Education Act Part C\nFund for the Improvement of Postsecondary Education (FIPSE)- HBCU\, TCCU\, and MSI Research and Development Infrastructure Program (ALN 84.116H)\n\nData Sovereignty\nHigh-quality\, culturally relevant data collection is critical to meeting the educational needs of American Indian\, Alaska Native\, and Native Hawaiian (AI/AN and NH) students. In 2018\, the U.S. Commission on Civil Rights’ Broken Promises report found that under 2007 guidelines (72 FR 59266)\, the Department collected data reports only from AI/AN students\, who did not indicate that they were ‘multiracial’. This guideline will be updated with the Office of Budget and Management’s (OMB) revisions to Statistical Policy Directive No. 15 Standards for Maintaining\, Collecting\, and Presenting Federal Data on Race and Ethnicity. Along with federal data\, Tribal Nations have a sovereign right to collect\, use\, manage\, and access their data. \nThe Department is seeking input from Tribal Leaders and Tribal Education Departments regarding the development\, collection\, protection\, and application of data sovereignty\, including as it relates to education\, student counts\, traditional knowledge\, and Native languages. \nThe Family Educational Rights and Privacy Act (FERPA)\nFERPA (20 U.S.C. § 1232g; 34 CFR Part 99)\, is a federal law that is administered by the Student Privacy Policy Office (SPPO) in the U.S. Department of Education (Department) that provides certain rights for parents regarding their children’s education records. When a student reaches 18 years of age or attends an institution of postsecondary education at any age\, he or she becomes an “eligible student\,” and all rights under FERPA transfer from the parent to the student. FERPA applies to schools that receive funding under any program administered by the Department. Private and faith-based schools at the elementary and secondary levels generally do not receive such funding and are\, therefore\, generally not subject to FERPA. \nFERPA protects “education records\,” which are generally defined as records that are directly related to a student and maintained by an educational agency or institution or by a party acting for the agency or institution. An “educational agency or institution\,” generally means a school district\, a public elementary or secondary school\, or an institution of postsecondary education such as a college or university. \nUnder FERPA\, an educational agency or institution generally may not disclose personally identifiable information (PII)\, from a student’s education records to a third party unless the student’s parent has provided prior written consent. However\, there are a number of exceptions to FERPA’s general consent requirement that permit a school to disclose PII from education records without consent\, but they are not required to do so by FERPA. DESCRIPTION:June 24 at 3:00 pm Eastern\nRegister \nOn May 22\, 2024\, FDA issued a Dear Tribal Leader Letter inviting all federally recognized Tribes to an All Tribes Call on June 24\, 2024\, at 3:00pm EST. This call will be to discuss the recently released Standards for the Growing\, Harvesting\, Packing\, and Holding of Produce for Human Consumption Relating to Agricultural Water (Agricultural Water Final Rule) issued under the FDA Food Safety Modernization Act (FSMA). \nThe rule represents an important step towards enhancing the safety of produce\, as agricultural water can be a major conduit for pathogens that can contaminate produce. \nDuring the call\, FDA will provide an overview of the final rule and address submitted questions from Tribes and take live comments and questions posed by those in attendance. \nThe final rule replaces certain pre-harvest agricultural water requirements for covered produce (other than sprouts) in the 2015 produce safety rule with requirements for systems-based agricultural water assessments to determine and guide appropriate measures to minimize potential risks associated with pre-harvest agricultural water. Specifically\, this rule: \n\nEstablishes requirements for agricultural water assessments that evaluate a variety of factors that are key determinants of contamination risks associated with pre-harvest agricultural water; this includes an evaluation of the water system\, water use practices\, crop characteristics\, environmental conditions\, potential impacts on water from adjacent and nearby land\, and other relevant factors;\nIncludes testing pre-harvest agricultural water as part of an assessment in certain circumstances;\nRequires farms to implement effective mitigation measures within specific timeframes based on findings from their assessments. Hazards related to certain activities associated with adjacent and nearby land uses are subject to expedited mitigation; and\nAdds new options for mitigation measures\, providing farms with additional flexibility in responding to findings from their pre-harvest agricultural water assessments.\n\nThe rule also finalizes the dates for compliance with the pre-harvest agricultural water requirements for non-sprout covered produce as follows: \n\nFor very small farms: 2 years\, 9 months after the effective date of the final rule\nFor small farms: 1 year\, 9 months after the effective date of the final rule\nFor all other farms: 9 months after the effective date of the final rule\n\nThe call is a virtual event. DESCRIPTION:United South and Eastern Tribes\, Inc. presents the Reclaiming Native Psychological Brilliance: Wise Practices\, a Tribal Behavioral Health ECHO Clinic. Native Psychological Brilliance refers to the intelligence\, strengths\, balance\, innate resources\, and resilience of Native people. This no-cost telehealth series will be held on the fourth Tuesday of every month at 1:00 pm Central/2:00 pm Eastern. Each session will be one hour in length. \nWho should attend? Tribal Nation health directors\, clinic staff\, counselors\, social workers\, physicians\, nurses\, Tribal Epidemiology Center staff\, and anyone supporting Tribal Nation citizens through the health/behavioral health sector are welcome to join. \nThe one-hour Reclaiming Native Psychological Brilliance virtual series will provide an opportunity for participants to: \n\nGain skills on strength-based approaches in partnership with Native People to enhance Native behavioral health\,\nDiscuss ways that Native brilliance is demonstrated and supports behavioral health\, and\nLearn about Native brilliance examples to share with behavioral health and other health care staff\, as well as with local Tribal Nation citizens.\n\nThe concept of Native psychological brilliance will be celebrated through Native music videos and Native spoken word performances as part of each session of the Reclaiming Native Psychological Brilliance series. \nContinuing education credits will be provided. \nRegister in advance for the session. \nFor questions\, please contact Bernice Jordan\, Public Health Manager\, at bjordan@usetinc.org.
